Rewards4Racing Member Account Agreement
This Agreement is a legal document, which sets out your rights and obligations, and those of Rewards4Racing ("we", "us" or "Rewards4Racing"), in relation to this site and the services offered by us through it (the "Rewards4Racing Service"). You must take the time to read and understand it before registering for the Rewards4Racing Service. By registering, you accept that you are entering into a contract with us on the terms of this Agreement. You should be aware that this Agreement may change from time to time in accordance with Clause 19 below.
People who register for the Rewards4Racing Service establish an "Account", and become "Members".
2. The Rewards4Racing Service
The Rewards4Racing Service allows Members to earn cashback from tracked purchases from retailers (“Cashback”). The Cashback earned is then converted by us into Rewards4Racing points (“Rewards4Racing Points”) which can be used to gain a discount on your next purchase with Jockey Club Racecourses. Rewards4Racing Points will be added to your Account within 48 hours of any Cashback being paid. To qualify for Cashback, the retailer must confirm that the Member’s purchase is tracked, genuine and successful (constituting a "Qualifying Transaction"), and your resulting referral fee must be received by us (becoming “Cashback” as a result). When we refer to retailers, we mean sellers and suppliers of goods or services and other businesses that work with us (such as price-and quote-comparison services).
Our help pages and other service documentation available on the Rewards4Racing site provide further information about our service; you should consult them concerning queries or issues you may have about the Rewards4Racing Service.
3. Obtaining an Account
You must be at least 16 years of age to obtain an Account. A person may have no more than one Account. You must be a resident of the UK to register for a Rewards4Racing Account.
You must register for the Rewards4Racing Service using accurate and current information about yourself - including your correct name, address and any other requested details. You should keep this information updated through your Account.
Important: You must ensure that the email address we hold for you is kept up-to-date and that you have full access to it - we will be sending you important messages there. If you change email address, then you must change the address we hold for you on your Account.
On acceptance of your registration, you will be allocated a Member's account. You will be able to monitor the balance of your Rewards4Racing Points by logging in to your account online.
Only one registration or account per person will be accepted. We reserve the right to close multiple accounts registered by the same person and to cancel Rewards4Racing Points collected on such accounts at our discretion.
We reserve the right to vary or cancel any special incentives (such as free or promotional Rewards4Racing Points) without notice.
We reserve the right to suspend or terminate your Membership and/or cancel Rewards4Racing Points collected at any time for any good reason, e.g. if you breach these terms and conditions.
4. Card Registrations
You may only register a maximum of 15 Identifier Card Numbers per Member Account, however this may include cards belonging to other members of your household/family providing that they have consented to the registration of their Identifier Card Number(s) to assist you to collect points. We may request that you provide written evidence of such consent at any time. If we are not satisfied that all Identifier Card Numbers are included with the holder's consent we reserve the right to de-register any or all Identifier Card Numbers on your Account.
Each Identifier Card Number may only be registered at any one time to one service in the world through which cards are used as identifiers for the purpose of crediting rewards (whether Rewards4Racing Points or other kinds of rewards) when shopping with designated retailers. In the event of more than one attempted registration of the same Identifier Card Number the last registration will prevail and previous registrations will be automatically de-registered.
5. Cashback & Rewards4Racing Points
After a Member successfully completes a Qualifying Transaction, and once we have received the resulting Cashback for that Qualifying Transaction, we convert that Cashback into Rewards4Racing Points which are then automatically (within 48 hours of the Cashback being paid) added to the Member’s Account.
Please note that there are various circumstances in which a transaction with a retailer may not constitute a Qualifying Transaction or Cashback may not result from it. Our help pages provide further information about these circumstances.
There are various circumstances in which Cashback will not be payable, and Rewards4Racing Points will not be allocated to the Member, and will be forfeited to us, namely:
a. where the Cashback payment that we receive is not attributed to a Qualifying Transaction or associated with an Account (such as where the Member is not logged-in to the Rewards4Racing Service when making the relevant purchase)
b. the transaction to which the Cashback relates is cancelled after it has been entered into (whether under the right of cancellation that applies to some sales made at a distance, or otherwise)
i. the Cashback is attributed to a Member or Account that has been:
i. suspended by us under Clause 7 or Clause 11 of this Agreement;
ii. associated with any fraudulent activity or any breach of this Agreement;
iii. used to make purchases on behalf of, or for the benefit of, any other person;
c. where the Cashback is held in, or attributable to, an Account that has been inactive for more than twelve months.

6. Redemptions & Rewards
You may only spend Rewards4Racing Points on products of the type, description and detailed specification that we publish as rewards, using the Rewards4Racing website or other methods that we prescribe, at a date when you have sufficient Rewards4Racing Points 'available' to complete a purchase of your chosen reward(s). We reserve the right to change the number of Rewards4Racing Points required for a particular reward without notice or to designate one publishing medium as the prevailing one in the event of a conflict of information.
Rewards4Racing Points that are not shown as 'available' on your Account statement cannot be used, inter alia, until they have been cleared by the relevant retail partner who is responsible for them.
If you have breached these terms and conditions, or for any other good reason, we may refuse to process an order for rewards. For Members under 18, we reserve the possibility of requiring written consent from your legal guardian before processing your order for rewards.
Sale or transfer of Rewards4Racing Points to another person or Member's account is not permitted. All rewards are subject to promotional availability. We reserve the right to withdraw or vary any offer in any way without prior notice.
If you make a claim for a product which has been withdrawn or which cannot be delivered within a reasonable period, you will be entitled to reinstatement of your Rewards4Racing Points deducted from your Account.
We reserve the right to deliver goods or tickets to the address entered as your address in our records and it is your responsibility to keep us informed of your current delivery address.
Unless otherwise specified, delivery within the UK is free of charge and will normally take place within 28 days of receipt of your order. We will endeavour to contact you if there is an unexpected delay.
No representations are made regarding the quality of rewards goods, but if you are dissatisfied with your purchase you will be entitled to return rewards goods at your cost within 28 days of delivery and providing that the returned goods are received in the same condition complete with packaging and accessories as supplied to you, your Rewards4Racing Points balance will be reinstated.
Unless the terms applicable to specific rewards services state otherwise, you will not be entitled to cancel an order placed for rewards services with effect from our acceptance of the order, or with effect from the despatch of tickets or vouchers entitling you to the service.
Non-receipt will be investigated if this is notified to us within two months of the date of the delivery (or within three months of the date of making an order for rewards if the delivery date is unclear).
For deliveries outside the UK, we reserve the right to charge (or deduct an additional number of Rewards4Racing Points from your Membership Account) to cover additional postage or delivery costs. You will be responsible for the payment of any import and other similar exchange duties upon receipt of any goods. We will not be liable if any of our retail partners (or their suppliers) refuse to provide services to Members living outside the UK.
7. Account and Programme Suspension or Termination & Dormant Accounts
If the Rewards4Racing programme is terminated, we will provide a period to allow you to spend your Rewards4Racing Points on goods and services. After this period has expired, your Account will be closed, no further redemptions will be possible and any residual Rewards4Racing Points balances will be cancelled. The period will be made clear on the website at the time of any decision to terminate or suspend the Rewards4Racing programme.
Within a period of 3 months after earning Cashback and/or Rewards4Racing Points when shopping with any of the in-store retailers using your Identifier Card Number(s) you must logon to your Account to activate these Points and ensure that they are available for use. If you do not logon to your account within this 3 month period, then the Rewards4Racing Points earned in-store with the relevant retailer(s) will be cancelled and cannot be used.
If for any period of 6 months you do not logon to your Rewards4Racing Account, then the status of your account will be amended to a ' Dormant Account '. If you have a ‘Dormant Account’ you will no longer be able to earn Rewards4Racing Points when shopping with in-store retailers using your Identifier Card Number(s).
We reserve the right to terminate any Account that has been a Dormant Account for a period of 6 months or more. We will make every effort to contact the Member, via their nominated email address, to notify the Member that their Account is at risk of termination through inactivity. If a reply is received confirming that the Account is still active we will continue to maintain the Account. In the absence of a satisfactory response, the Account will be terminated, and any Rewards4Racing Points balance cancelled.
8. Intellectual Property
By uploading or including any material on the Rewards4Racing Service, a Member expressly grants:
a. to us a non-exclusive licence (including the right to grant sub-licences) to use, reproduce and distribute that material through the Rewards4Racing Service and any other interactive services through which we or our sub-licensee make the Rewards4Racing Service (or a service based on the Rewards4Racing Service) available; and
b. to other Members (through us, under the licence referred to in a. above), the non-exclusive, personal, non-transferable right to view the relevant material.
You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to the Rewards4Racing Service (including the material which is contributed by Members or retailers) are owned by, or licensed to, us. It is easy to copy material which appears on web-sites, but this does not mean it is legal. Therefore, no-one may copy, distribute, show in public or create any derivative work from the Rewards4Racing Service, or any of the material which is found on the Rewards4Racing Service unless properly licensed to do so by us.
Given the global nature of the World Wide Web, please note that a posting on the Rewards4Racing Service may be accessible to internet users around the world.
10. Our Role
Rewards4Racing is not a party to any transactions with retailers, and is not the seller or supplier of any of the goods or services that they make available. Thus we do not have any of the legal obligations that apply to the sellers of those goods or services.
Accordingly, we have no control over or responsibility for:
a. the quality, safety, or legality of those goods or services available from retailers; or
b. whether the retailer can or will supply and pass good title to any goods or services.
Members should exercise no lesser degree of caution in entering into transactions with retailers than they would when entering into a similar transaction offline.
To the extent that the law permits, you release us, our agents and employees from all liability arising out of or in connection with any transactions with retailers, including (without limitation) all claims and demands relating to uncompleted or completed transactions with retailers, or goods or services offered for sale or supply, or actually sold or supplied, through or in connection with any transactions with retailers.
We reserve the right to suspend or terminate any Member’s access to the Rewards4Racing Service, or parts of it, if in our reasonable view the relevant Member or Account appears to be in breach of any provision of this Agreement.
An Account should be used only for purchases on the Member’s own behalf, and not on the behalf of, or for the benefit of, any other person(s).
Members must not enter into, or attempt to enter into, any transaction with a retailer or to gain Cashback (a) by providing personal information of someone else, or a payment method which they are not entitled to use, (b) by deceptively or unfairly exploiting a retailer’s offering, or (c) in breach of any terms and conditions applied by Rewards4Racing or the retailer to that transaction.
It is each Member’s obligation to ensure that any material posted by him/her or associated with his/her Account:
a. is not defamatory, offensive, or abusive or of an obscene, indecent or menacing nature;
b. is not intended or likely to cause needless annoyance, inconvenience or distress to any person;
c. does not contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data or personal information;
d. does not contravene any applicable law or regulation (including, but not limited to, laws governing consumer protection, distance selling, unfair competition, anti-discrimination, false advertising, copyright, trademark and privacy);
e. does not breach the rights of any person or entity (including any rights or expectations of privacy);
f. where it constitutes feedback on a retailer, is accurate and fair; and
g. does not advertise any goods or services
If you see or experience anything on the Rewards4Racing Service that appears to infringe any of the above requirements, we would like you to inform us by emailing email@example.com
Each Member acknowledges that we are entitled, but not obliged, to withdraw any material, which appears - based on information received from third parties or other Members - to be in breach of this Agreement.
12. Contact from third parties
If anyone contacts us in relation to material or transactions associated with you or your Account, then you agree:
a. to provide all reasonable information and assistance we may require in connection with responding to that contact; and
b. to respond promptly and accurately to it, should we pass the message to you for a response.
13. Additional services
We or our partners may offer new or additional services through the Rewards4Racing Service from time to time. Your use of those services may be subject to additional terms and conditions, which you must comply with. Provided that those terms are notified to you on the Rewards4Racing Service in an appropriate manner (as determined by us in our reasonable discretion) when you agree to take those services, any failure by you to comply with a material provision of the terms governing those services will amount to a breach of this Agreement.
14. Operation of the Rewards4Racing Service
We reserve the right to withdraw, modify or suspend aspects of the Rewards4Racing Service, or the entirety of it, where we have legal, security, technical or commercial reasons to do so. We will endeavour to give you 30 days advance notice before taking such action, except where it is necessary to take earlier action for security reasons or because of technical difficulties which would otherwise adversely affect the Rewards4Racing Service. There may also be times when the Rewards4Racing Service becomes inaccessible as a result of technical difficulties experienced by Rewards4Racing or on the Internet; we will, however, use reasonable skill and care to overcome these difficulties where they are within our control. Please note, however, that we cannot guarantee continuous access to the Rewards4Racing Service or any of the content that appears on it.
Nevertheless, we will strive to ensure that any periods of planned unavailability, which you will be informed of when you access the Rewards4Racing Service at the relevant time, are kept to a minimum.
For security or other reasons, we may require you to change password or other information which facilitates access to the Rewards4Racing Service; however, we will never ask you for your password via email, telephone, or any other means other than through the www.rewards4racing.com website. You are solely responsible for maintaining the confidentiality of your password and any additional identifying information.
a. We warrant that the Rewards4Racing Service will be provided with reasonable care and skill with the intention of meeting our specifications for the Rewards4Racing Service, but we cannot and do not guarantee that the Rewards4Racing Service will meet your requirements.
b. Rewards4Racing shall be liable as expressly provided in this Agreement, but shall have no other obligation, duty or liability whatsoever in contract, tort (including negligence, breach of statutory duty and any other tort) or otherwise.
c. Nothing in this Agreement shall exclude or restrict our liability for death or personal injury resulting from our negligence.
d. Subject always to sub-Clause e. below, Rewards4Racing shall be liable for direct loss or damage only, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise, and whether caused by its act or omission or that of its employees, agents or subcontractors. Rewards4Racing's aggregate liability during any successive period of twelve months, the first of which shall be deemed to begin on the date when you obtain your Account, shall be limited to the Cashback (or Rewards4Racing Points equivalent) payable to you to us in respect of that twelve-month period (but without limiting our obligation to pay Cashback to Members to the extent provided in this Agreement).
e. We will not be liable to you or anyone else, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise:
i. for any loss of revenue, business, anticipated savings or profits, or
ii. for any indirect, special or consequential loss damage, costs or other claims, howsoever caused or arising, whether through non-supply or late supply of the Rewards4Racing Service or other non-performance of this Agreement or otherwise.
f. Except as expressly stated elsewhere in this Agreement, all representations, warranties, conditions and other terms, whether express or implied (by common law, statute, collaterally or otherwise) are hereby excluded, except in the case of fraud, or where such exclusion is not permitted by law.
g. For the avoidance of doubt, Rewards4Racing will not have liability to you or any other person in respect of material contributed by Members, transactions (or non-transactions) with retailers, or any activity or communication relating to such material or transactions.
h. The provisions of this Clause 15 shall survive the termination or expiry of this Agreement.
You agree to indemnify Rewards4Racing against all liabilities, claims and expenses that may arise out of or in connection with (a) any breach of this Agreement by you or through your Account, or (b) any transaction with a retailer.
We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement, but will not do so in such a way as to reduce any guarantees you are given under this Agreement. You may not without the written consent of Rewards4Racing assign or dispose of this Agreement, nor subcontract any of your rights and obligations under it.
18. Entire Agreement
This Agreement is intended to contain your entire agreement with us relating to the Rewards4Racing Service; we believe it to be fair and reasonable. It replaces all earlier agreements and understandings with you relating to the Rewards4Racing Service, except for any fraud or fraudulent representation by either of us.
19. Changes to this Agreement
We reserve the right to change this Agreement from time to time, and post the new version on the Rewards4Racing Service. When we do so, we will post the new version of the Agreement on the Rewards4Racing Service, and the new version of these terms and conditions will take effect, and will govern the Rewards4Racing Service and your relationship with us:
a. commencing no less than thirty days after the date of posting (or such later date as we indicate in the relevant posting), if any of the changes is to an operative provision of this Agreement which is capable of adversely affecting you; if you do not wish to be governed by the new version of the Agreement, you may notify us on or before the date when the new version of the Agreement is to take effect, and from that date you must cease to use the Rewards4Racing Service; or
b. immediately upon the date of posting (or such later date as we indicate in the relevant posting), if the changes are not to operative provisions, or not capable of adversely affecting you - examples of which would include, without limitation, changes to contact details referred to, or the refinement of provisions that are already included, in this Agreement.
In the event that any term of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. You and Rewards4Racing are independent contractors, and no agency, partnership, joint venture or employee-employer relationship is intended or created by this Agreement. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
This Agreement, and our relationship with you and each Member, is governed by the laws of England and Wales.
You and we each submit to the non-exclusive jurisdiction of the English courts in relation to disputes arising in connection with this Agreement.
22. Keeping this Agreement
We don't separately file the individual Agreements entered into by Members when they register for the Rewards4Racing Service. You can access it at www.rewards4racing.com. Please make a durable copy of this Agreement by printing and/or saving a downloaded copy on your own computer. It is offered in English only.
We are Rewards4Racing Limited, and our address for correspondence and queries is Rewards4Racing Limited, The Stables, Catton Hall Estate, Catton, South Derbyshire DE12 8LN. We are a company registered in England and Wales under registration no. 7070575. Our VAT registration number is 101 5322 78. Please note that all communications (including formal notices) under this Agreement are to be sent and received by email. For this purpose, your notices should be sent to the following email address firstname.lastname@example.org and we will send our notices to you at the email address you notify to use when you register as a Member, as changed subsequently in your Account details.
